Motorist Awarded $750,000 in Ocean County Lawsuit
A woman who suffered neck and shoulder injuries, as well as traumatic brain injury when her vehicle was struck from behind, was awarded $750,000 in binding arbitration in her Ocean County lawsuit.
Our client was yielding to traffic on the ramp from Airport Road onto Cedarbridge Avenue in Lakewood when her SUV was struck from behind by a pickup truck operated by the employee of an electrical supply company. The driver of the pickup failed to notice that our client had stopped on the ramp to yield to oncoming traffic when he struck her vehicle. Maggs McDermott & DiCicco filed suit against the pickup driver and the electrical supply company.
Our client, who was sixty-two at the time of the accident, hit her head on the steering wheel before her body was snapped back by the locking of her seatbelt. An MRI revealed spinal stenosis requiring her to undergo an epidural steroid injection in her neck at the C6-C7 level and trigger point injections.
In addition, our client suffered a torn rotator cuff in her left shoulder, for which she received a steroid injection. Following the injection, she underwent arthroscopic surgery with rotator cuff repair, distal clavicle resection and subacromial decompression. After the shoulder surgery, she continued to suffer pain and limitations, requiring another steroid injection to her left shoulder. An additional MRI revealed a recurrent tear of the left rotator cuff, and she underwent a second arthroscopic surgery to the left shoulder. Today she continues to experience neck and left shoulder pain, and headaches.
The settlement for $750,000 was against both the driver of the pickup truck and their employer.
