HOWELL WOMAN RECEIVES $250,000 FOR INJURIES WHILE DINING AT A PIZZA PARLOR
A 56-year old Howell woman received a $250,000 settlement for injuries she sustained when she was suddenly struck by a free-standing wooden partition while attending a party at a local pizzeria.
The woman sustained many injuries, including a complete tear of her right rotator cuff and a partial tear of her left rotator cuff. She underwent multiple steroid injections to both shoulders which provided limited relief of her pain and limitations, ultimately requiring surgery to her right shoulder. She also sustained a concussion, causing headaches, light sensitivity, dizziness and nausea. Finally, the incident resulted in a cervical disc herniation at C5-6 and a bulging disc at C6-7.
The partition being used by the pizzeria was a portable wooden structure and was not anchored in place. It was a hazardous and dangerous condition which one witness described as “an accident waiting to happen.” The owner of the pizzeria discarded the partition immediately following the accident in an attempt to eliminate the evidence, resulting in claims against the pizzeria for spoliation of evidence.
Even following surgery and treatment, the woman still suffers pain and limitations in her shoulders effecting her ability to perform her job and enjoy her everyday activities. Our client received a $250,000 settlement.
