Pedestrian Hit in Parking Lot Receives $300,000
A 56-year-old man was pushing a shopping cart across the parking lot of the BJ’s Shopping Center in Manahawkin when a car suddenly hit the shopping cart, throwing the man to the ground and causing significant injuries. The driver of the vehicle, a 79-year-old woman, was attempting to make a left turn to exit the shopping center. During our investigation, the woman admitted that she was looking at the oncoming traffic and never saw the man prior to striking the shopping cart.
The man sustained injuries to his neck, back and right shoulder. He was diagnosed with disc herniations in his neck at C3-4, C4-5 and C5-6, disc herniations in his back at L5-S1, and a right rotator cuff tear. As a result of his injuries, the man underwent a three-level anterior cervical (neck) discectomy and fusion.
Due to the extent and nature of his injuries, the case settled for the full policy limits of $300,000.
