Colts Neck Man Receives $400,000 for Automobile Accident Injuries

A Colts Neck man accepted a $400,000 settlement for claims arising from a June 1, 2015 automobile accident with the help of Maggs McDermott & DiCicco.  The accident occurred when a vehicle attempted a left-hand turn onto Village Center Drive from Route 537 in Freehold Township, but instead turned directly into the lane and path of travel of the Colts Neck man, who was proceeding through the intersection with the right-of-way on a green light.

The victim was represented by James A. Maggs, Esq. and Victoria J. Adornetto, Esq. of Maggs McDermott & DiCicco, LLC, Wall Township, New Jersey.  According to Ms. Adornetto, the client sustained significant, permanent injury to his lumbar spine as a result of the accident, which caused instability, deterioration and further pathology of the adjacent spinal level, requiring five separate pain management procedures, followed by a two-level micro-discectomy surgery in December 2017.  Unfortunately, the physical condition of our client’s spine continued to deteriorate even despite the initial surgery, requiring a second surgical intervention consisting of a single-level revision lateral discectomy in September 2019.  According to the Firm’s medical expert, the condition of the client’s spine will likely require a more extensive multi-level surgical fusion in the future.  In addition, the client sustained a small rotator cuff tear in his left shoulder, which was conservatively managed.

Following extensive trial preparation and negotiations, the matter was resolved during trial for $400,000.
